ONLINE PRIVACY POLICY

    • Website Owner.Acland Apparel, LLC (“Acland,” “we,” “us,” and “our”) is the owner of this web site, including all successor pages (“(Acland Website)”). Acland can be contacted by mail at 9501 N. FM 620 ROAD, UNIT 2202, AUSTIN, TEXAS 78726, by phone at (512)565-2214, or by e-mail at [email protected]. This Online Privacy Policy (the “Policy”) discloses Acland information practices for the Acland Website, including what type of personal identifiable information is requested in order to make a purchase, how the information is used, and with whom the information is shared.
    • Website Visits. In general, you can visit on the Acland Website without directly sharing any personal information. However, Acland may collect certain information from Acland Website visitors. This information includes, but is not limited to, the home server domain name, e-mail address, type of computer and web browser, what pages visitor accessed, and limited information about search requests. This information is used to solve technical problems and to calculate overall usage statistics.
    • Website Transactions. At times, Acland will need personal information regarding a customer or a prospect. For example to process an order or provide a subscription, Acland may need to know a customer’s name, mailing address, e-mail address and credit card details. It is Acland‘s intent to inform you know before Acland collects personal information, such as user’s name and/or address on the Internet. If you tell us that you do not wish to have this information used as a basis for further contact with you, Acland will respect your wishes.
  1. Personal Information That May Be Collected.
    • Identifying Information. In order to make a purchase or to access designated subscriber services and /or restricted areas within the Acland Web site, Acland will request a user to provide certain personal identifying information, which may include: legal name, postal address, e-mail address, screen name, password, telephone number, facsimile number, method of payment, and, if applicable, credit card number (“Personal Information”). Acland may request additional information necessary to establish and maintain customer’s account. Personal Information does not include information that has been aggregated or made anonymous such that it can no longer be reasonably associated with a specific person.
  • Service Quality Monitoring. Some Acland Website transactions may require a customer to telephone Acland, or Acland to call the customer. Acland will not contact you by telephone without your prior consent, except to confirm an order placed online and/or to inform a customer of the status of such order. Customer should be aware that it is Acland‘s practice to monitor, and in some cases record such calls for staff training or quality assurance purposes.
  • Information from Children. Acland does not sell products or services for purchase by children, and will not collect or post information from a child under the age of 18 without the involvement of a parent or guardian. If provided with the appropriate information, Acland will notify the child’s parent or guardian at the e-mail address provided by the prospective customer, alerting the parent or guardian to the child’s use of the Acland Website and providing instructions as to how the parent or guardian can delete the child’s registration from the Acland Website. Acland does not use personally identifying information collected from children for marketing or promotional purposes, and does not disclose such information to any third party for any purpose whatsoever.
  • Lost or Stolen Information. If a customer’s credit card and/or password is lost or stolen, the customer should promptly notify Acland in order to enable Acland to cancel the lost or stolen information and to update its records with a changed credit card and/or password.
  • Chat Rooms, Forums and Bulletin Boards. If customer participates in an Acland chat room, discussion forum, or posts messages to an Acland bulletin board, customer should be aware that the information disclosed and shared will be broadly available to other persons, both inside of and/or outside Acland, who have access to that chat room, forum or bulletin board. Some individual Acland chat rooms, forums or bulletin boards have additional rules and conditions regarding participation. Also, participant’s expressed opinion is his or her own and should not be considered as reflecting the opinion of Acland.
  • Links to Other Web Sites. The Acland Website may contain links to other web sites (collectively, “third-party websites”). Acland does not operate or control such third-party websites, nor is Acland responsible for the privacy practices or the content thereof. Please always review the applicable privacy practices of such third-party websites before deciding whether to provide any personal and/or financial information to them.
  1. Uses Made of the Personal Information.
    • Limited Uses Identified. Without customer’s prior consent, Acland will not use your Personal Information for any purpose other than that for which it is submitted. Acland uses Personal Information to reply to inquiries, handle complaints, provide operational notices and in program record-keeping. We may share your Personal Information with trusted third parties who are integral to the operation of the Acland Website and in order to fulfill your order or purchase, as well as any third parties you have directly authorized to receive your Personal Information. We may store your Personal Information in locations outside the direct control of Acland, for instance, on servers or databases co-located with hosting providers. If you authorize an application to access your Acland account, you acknowledge that we may share payment transaction data and related information with the third party that provides the authorized application. The use of your information by such third party will be subject to their applicable privacy policy, which you should carefully review.
    • Marketing Uses. Acland does not sell or rent your Personal Information to marketers or third parties.
    • Stored Information Uses. Acland stores and retains the information provided by customer. Stored information is used by Acland and Acland agents: to support customer interaction with the Acland Website; to deliver customer purchases; and/or to contact customer again about other Acland products and services. We may occasionally email you with information about offers or new services. You can opt out of these email communications by replying with “unsubscribe” in the subject line, or via an unsubscribe link included in such communications. However, you will continue to receive certain email communications related to your account, including information regarding transactions and your relationship with Acland.
    • Online Advertising. Some companies that help Acland deliver interactive on-line advertising, such as banner ads, may collect and use information about Acland‘s customers to help Acland better understand the types of advertising or promotions that are most appealing to Acland‘s customers. After it is collected the information is aggregated so it is not identifiable to a specific individual. If, however, customer would prefer that these companies not collect such information, you may contact Acland and request that your information not be collected.
  2. Disclosure of the Personal Information.
    • Within Corporate Organization. Acland is a multinational organization, with legal entities, business processes, management structures, and technical systems that cross borders. Acland may share your personal information within the Acland corporate organization, and may transfer the information to countries in the world where Acland conducts business. Some countries may provide less legal protection for customer personal information. In such countries, Acland will still handle customer personal information in the manner describe herein.
    • Mergers and Acquisitions. Circumstances may arise where for business reasons, Acland decides to sell, buy, merge or otherwise reorganize its businesses in the United States or some other country. Such a transaction may involve the disclosure of Personal Information to prospective or actual purchasers, and/or receiving such information from sellers. It is Acland‘s practice to seek appropriate protection for Personal Information in these types of transactions.
    • Agents. Acland may employ or engage other companies and individuals to perform business functions on behalf of Acland. These persons may be provided with Personal Information in order to perform their functions, but are prohibited by contract from using the information for other purposes. These persons may engage in a variety of functions which include, but are not limited to, fulfilling orders, delivering packages, removing repetitive information from customer lists, analyzing data, providing marketing assistance, processing credit card payments and providing customer services.
    • Affiliated Businesses.Acland may work closely with affiliated businesses operating web site stores, providing services or selling products on each other’s websites. These businesses identify themselves to customers. Customer information related to a transaction with an affiliated business is shared with that affiliated business.
  • Disclosure to Governmental Authorities. Acland may release Personal Information to appropriate governmental authorities where release is required by law (for example, a subpoena) or by a regulation, or is requested by a government agency conducting investigations or proceedings.
  1. Use of Computer Tracking Technologies.
    • No Tracking of Personal Information. Acland ‘s Website is not set up to track, collect or distribute Personal Information not entered by visitors. Through website access logs, Acland does collect clickstream data and HTTP protocol elements, which generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff for research and development, user analysis and business decision making, all of which provides better services to the public. The statistics garnered, which contain no Personal Information and cannot be used to gather such information, may also be provided to third parties.
    • Use of Cookies. Acland, or its third-party vendors, collect non-identifiable and personal information through the use of various technologies, including “cookies.” A cookie is an alphanumeric identifier that a website can transfer to customer’s hard drive through customer’s browser. The cookie is then stored on customer’s computer as an anonymous tag that identifies the customer’s computer, but not the customer. Cookies may be sent by Acland or its third-party vendors. Customer can set its browser to notify customer before a cookie is received, giving an opportunity to decide whether to accept the cookie. Customer may also set its browser to turn off cookies; however, some websites may not then work properly, and this may also limit your ability to use the Acland Website.
    • Use of Web Beacon Technologies. Acland may also use Web beacon or other technologies to better tailor its Acland Website to provide better customer service. If these technologies are in use, when a visitor accesses these pages of the website, a non-identifiable notice of that visit is generated which may be processed by Acland or by its suppliers. Web beacons usually work in conjunction with cookies. If customer does not want cookie information to be associated with customer’s visits to these pages, customer can set its browser to turn off cookies; however, Web beacon and other technologies will still detect visits to these pages, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.
    • Collection of Non-Identifiable Information. Acland may collect non-identifiable information from user visits to the Acland Website in order to provide better customer service. Examples of such collecting include traffic analysis, such as tracking of the domains from which users visit or tracking numbers of visitors; measuring visitor activity on the Acland Website; Acland Website and system administration; user analysis; and business decision making. Such information is sometimes known as “clickstream data.” Acland or its contractors may use this data to analyze trends and statistics.
    • Collection of Personal Information. Acland collects personal identifying information from customer during a transaction. Acland may extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help Acland understand trends and patterns. This information is not reviewed at an individual level.
  2. Information Security.
    • Commitment to Online Security. Acland uses industry standard encryption technologies when transferring and receiving Personal Information. Acland maintains security measures in its physical facility designed to protect against the loss, misuse or alteration of information that Acland has collected from user.
    • No Liability for Acts of Third Parties. Acland will exercise all reasonable efforts to safeguard the confidentiality of customer Personal Information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, Acland shall not be liable for unauthorized disclosure of Personal Information due to no fault of Acland including, but not limited to, errors in transmission and unauthorized acts of Acland staff and third parties.
  3. Privacy Policy Changes and Opt-Out Rights.
    • Changes to Privacy Policy. Acland reserves the right to change its Policy at any time. A notice of any material change will be posted on the Acland Website at http://b39.6f1.myftpupload.com for following the implementation of such change. There are two boxes at the end of Acland ‘s notice of material change: (1) an “I accept” box, and (2) an “I do not accept” box. If customer does not mark the “I do not accept” box, customer will be deemed to have accepted Acland ‘s notice of material change.
    • Opt-Out Right. Customer has the right at any time to cease permitting Personal Information to be collected, used or disclosed by Acland and/or by any third parties with whom Acland has shared and/or transferred such personal information. Right of cancellation may be exercised by contacting Acland via e-mail at [email protected], telephone or postal mail. After processing the cancellation, Acland will delete customer or prospective customer’s personal information from its data base.
  4. Access Rights to Data.
    • Information Maintained by Acland. Upon customer’s request, Acland will provide a reasonable description of customer’s personally identifiable information that Acland maintains in its data bank.     • Corrections and Changes to Personal Information. Help Acland to keep customer’s Personal Information accurate. If customer’s Personal Information changes, or if customer notes an error upon review of such Personal Information that Acland has on file, please promptly e-mail Acland at [email protected] and provide the new or correct information.
    • Your California Privacy Rights. Beginning on January 1, 2005, California Civil Code Section 1798.83 permits customers of Acland who are California residents to request certain information regarding Acland’s disclosure of personal information for their direct marketing purposes. To make such a request, please write to: [email protected]. Within 30 days of receiving such a request, Acland will provide a list of the categories of personal information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. Acland reserves its right not to respond to requests submitted other than to the address specified in this paragraph. California’s privacy laws require a company to provide notice to California users of their rights to receive information on to which entities their information was shared for marketing purposes.
  5. Accountability.
    • Questions, Problems and Complaints. If you have a question about this Policy, or a complaint about Acland’s compliance with this Policy, you may contact Acland by e-mail at [email protected]. If Acland is unable to resolve your complaint to your reasonable satisfaction or if customer does not receive acknowledgment of an inquiry, customer may elect to proceed by contacting Acland Apparel, LLC.
    • Terms of Use. If customer chooses to purchased products from or subscribe to Acland’s Services, customer’s action is hereby deemed acceptance of Acland practices described in this Policy. Any dispute over privacy between customer and Acland is subject to the provisions of this Policy and to Acland ‘s Terms of Use Agreement which is hereby incorporated herein and which can be read at aclandapparel.com In the event of any conflict between this Policy and the Terms of Use Agreement, the Terms of Use Agreement shall prevail.
